1.1 Access to and use of DoubleDateFirst.com ("DoubleDateFirst" or "the Website") and any of the Services referred to below, is subject exclusively to these Terms and Conditions. You will not use the Website and/or the Services for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website and/or the Services you are fully accepting that you have read, understand and agree to be bound by these Terms and Conditions whether or not you are a registered member of the Website and/or the Services. If you do not accept these Terms and Conditions you must immediately stop using the Website and/or the Services.

1.2 DoubleDateFirst reserves the right to withdraw or amend promotional offers, update or amend these Terms and Conditions at any time, for any reason and without prior notice as required by law or applicable safety requirements and your continued use of the Website and/or the Services following any changes shall be deemed to be your acceptance of such changes. If you do not agree to these Terms and Conditions or any future changes, do not use or access or continue to use or access the Website and/or the Services. It is your responsibility to check the Terms and Conditions regularly to determine if there have been any changes and to review such changes.

2. MEMBERSHIP AND THE SERVICES

2.1 The agreement between Friend A and Friend B (together "the Users") and DoubleDateFirst shall come into effect on the acceptance of the Users' application for membership ("Membership"). No application for Membership shall be deemed to be accepted by DoubleDateFirst until email confirmation of Membership has been acknowledged by the Users.

2.2 DoubleDateFirst is engaged in the business of providing an entertainment service which may include adding content to the site for entertainment value only. In addition DoubleDateFirst may provide communication tools such as email, bulletin boards, chat areas, news groups, forums and/or other message or communication facilities ("the Services").

2.3 DoubleDateFirst is fundamentally a channel where Friend A and Friend B communicate through the Services with other registered Users with valid Memberships. For this platform to work requires continuous Membership i.e. Friend A must always have a Friend B. Should Friend A cancel Membership or, for whatever reason, Membership is suspended then the Membership of Friend B is, by association, suspended or cancelled. Similarly, if Friend B requests to be removed from the Membership of Friend A, then the Membership of Friend A is no longer valid and access to the Services is suspended until such time as Friend A registers a new Friend B. If Friend A does not within one (1) calendar month register a new Friend B, then DoubleDateFirst reserves the right to cancel Membership.

2.4 DoubleDateFirst offers a facility which allows Friend A to post and amend comments about Friend B and for Friend B to post and amend comments about Friend A ("the Facility") which can be viewed by other Users of the Website and/or the Services. As such, registered Users of the website permit their Friend to post and amend comments and Users are requested to read this clause in conjunction with clauses 6, 15 and 16 below.

2.5 Membership will not be accepted without a qualifying photograph from both Friend A and Friend B. DoubleDateFirst have a set of guidelines for photographs and photographs are checked to ensure they meet these guidelines. If a photograph does not conform to these guidelines, it will be rejected. Membership will be suspended if an accepted photograph is removed and replaced with an unacceptable photograph.

DoubleDateFirst reserves the right to modify or crop uploaded photographs so that they fit the Website's requirements of size, width and height.

2.6 DoubleDateFirst has provided a link whereby the Users of the Services can elect to send their respective Profiles or Profiles of other Users to non-members of DoubleDateFirst. The recipient(s) of the Profile(s) can only view the Profile(s) and do not have any other access to the Services unless they apply and are granted Membership of DoubleDateFirst.

2.7 Unless stated otherwise the Services are for personal and non-commercial use only. Companies or any other commercial ventures are prohibited from accessing the Website and/or the Services and/or applying for Membership.

3. PRIVACY POLICY

DoubleDateFirst is committed to protecting the privacy of the Users and the confidentiality of the information provided by the Users using the Website and/or the Services. DoubleDateFirst will not sell or rent personal information to third parties for marketing purposes without the express consent of the Users. Users are referred to the Privacy Statement available on this website.

4. ELIGIBILITY

By accepting these Terms and Conditions the Users warrant and represent that they:

4.1 are 18 years of age or over. Any registration by, use of or access of the Website and/or the Services by anyone who is under 18 years of age is unauthorised, unlicensed and is in violation of these Terms and Conditions;

4.2 have not been convicted of any offence relating to violence and/or any offence under the Protection from Harassment Act 1997 (or under any statutory enactment replacing and/or amending such Act); and/or

1. have not been subject to any injunction or any order to pay damages under the Protection from Harassment Act 1997 (or under any statutory enactment replacing and/or amending such Act).

DoubleDateFirst reserves the right to terminate the Membership of Users found to be in breach of this clause and as such will take a view on a case-by-case basis any request for Refunds or part thereof.

5. ACCOUNT, PASSWORD AND SECURITY

5.1 The Users are required to register a username which is common to both Friend A and Friend B. For security purposes passwords are not common and each is required to register their own password. The Users must provide certain information, including but not limited to gender, age, appearance, education, ethnic background, religion, lifestyle information and general geographic location ("the Profile"). Information posted by the Users must be accurate, true, complete and not misleading. It is the Users responsibility to maintain the confidentiality and security of their username and their respective passwords and be fully responsible for all actions that take place under their Membership. The Users agree to notify DoubleDateFirst of any unauthorised use or breach of security. In no event will DoubleDateFirst be liable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of a username and/or password.

5.2 Friend A can register as many friends as they wish but for each friend registered, Friend A must apply for a separate Membership.

Friend A + Friend B = Membership = a common username with different individual passwords
Friend A + Friend C = Membership = a common username with different individual passwords

6. CONDUCT

By using the Facility, Friend A and Friend B warrants and represents that they have the authority to do so. Whilst DoubleDateFirst believes that Users should be able to express themselves, Users may not use our facility to:

6.1 post offensive content, this includes content that contains offensive language, sexually explicit content (including photographs), is slanderous, libellous, abusive, derogatory, demeaning, malicious, defamatory, abusive or hateful or that incites discrimination or violence on account of race, religion, disability, nationality or otherwise;

6.2 make threats of any kind, intimidate, harass or bully or otherwise violate any other user (including but not limited to rights of privacy and publicity);

6.3 publish content that contains advertising or commercial messages or send messages of a commercial nature to other Users of the Website/or the Services

DoubleDateFirst has the ability to actively moderate discussions and content within any of its chat facilities however we expect users to comply with the terms and conditions contained herein without intervention. Nevertheless DoubleDateFirst reserves the right to terminate the Membership of Users and delete the comments posted or suspend for a period of time those Users found in breach of these Terms and Conditions. Refunds or part thereof will not be given.

7. ACCEPTABLE USE

7.1 The Users acknowledge that all information, text, graphics, logos, photographs, images, moving images, sounds, illustrations and other materials ("the Content") whether posted publicly or transmitted privately by the Users is the sole responsibility of the Users from whom such Content originated. DoubleDateFirst does not control or endorse the Content and cannot guarantee the accuracy, integrity or quality of such Content. DoubleDateFirst will not be held liable in any way for any Content or for any loss or damage of any kind resulting from the use of any Content transmitted via the Services and the Users agree to bear all risk associated with the use of any Content including any reliance on the accuracy or completeness of such Content.

7.2 In using the Website and/or the Services the Users agree not to knowingly:

7.2.1 solicit personal information from anyone under 18 years of age or solicit passwords or personally identifying information for commercial or unlawful purposes;

7.2.2 upload, post, transmit, share or otherwise send junk email, spam, chain letters, pyramid schemes or any other unsolicited messages, commercial or otherwise;

7.2.3 upload, post, transmit, share, distribute or disseminate material or information that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside or confidential information);

7.2.4 use any information or material in any manner that infringes any copyright, trademark, patent or other proprietary right;

7.2.5 make available or upload files that contain a virus, worm, trojan or corrupt data that may damage the operation of the computer or property of another;

7.2.6 collect, share or store personal information, including, without limitation, addresses, email addresses, phone numbers and credit card numbers or attempt to gain unauthorised access to other accounts, computer systems or networks through hacking, password mining or by any other means;

7.2.7 impersonate any person or entity with intent to mislead;

7.2.8 encourage or provide instructions for a criminal offence, or violate any applicable laws or regulations; and

7.2.9 damage, disable, overburden or impair or interfere with any other Users use and enjoyment.

7.3 DoubleDateFirst reserves the right to monitor the Services and at our option remove any Content that breaches these Terms and Conditions or is otherwise objectionable or which restricts or inhibits other Users from using or enjoying the Website and/or the Services or which may expose DoubleDateFirst or other Users to any harm or liability of any type.

8. CHILD SECURITY

For the avoidance of doubt, Users under the age of 18 are not permitted. DoubleDateFirst is concerned about the safety and privacy of Users. Parents who wish to use the Website and/or the Services should do so responsibility. By allowing a child access to the Website you are allowing a child access to all of the Services, including email, bulletin boards, chat areas, news groups, forums and/or other message or communication facilities. DoubleDateFirst advises caution when revealing personally identifiable information.

9. PRICE AND PAYMENT

9.1 Membership is one (1) calendar month and the pricing of the Services ("the Membership Fee") is set out under the Website's FAQs page. Prices are inclusive of any applicable VAT.

9.2 Under the Consumer Protection (Distance Selling) Regulations 2000 (as amended), except in cases where Membership was taken up during a promotional offer, you are entitled to a seven-day cooling off period. During this time you have the right to cancel your Membership without penalty. However, the cooling off period and the right to cancel does not apply if you begin to use the Services before the end of the cooling off period. Therefore, if you use the Services immediately by accessing the Website, you will not be able to cancel the agreement.

9.3 Friend A shall pay all sums due by the means of the payment method specified. Payment shall not be deemed to be made until DoubleDateFirst has received cleared funds due under the Membership Fee. By providing DoubleDateFirst with payment information, you authorise and instruct DoubleDateFirst to bill your credit/debit card account for the amount of your initial Membership Fee, and to bill that credit/debit card 24 hours before your current Membership expires and again each time that the current term of your Membership is about to expire.

9.4 If in the event that Friend A:

9.4.1 does not want to renew Membership, you must notify DoubleDateFirst that you want to terminate access to the Services. Following notification, you will continue to have full access to the Services for the remainder of the term of your Membership for which you have paid, provided you are in compliance with these Terms and Conditions. Refunds will not be issued for early termination;

9.4.2 has Membership suspended because Membership is void, you will be charged at the normal rate throughout the period of suspension; and/or

9.4.3 fails to make any payment when due or has not notified DoubleDateFirst of any change to the payment method specified and DoubleDateFirst is unable to take payment, access to the Website and/or the Services will cease with immediate effect.

9.5 During any period of suspension or if Membership lapses DoubleDateFirst reserves the right to delete all Profiles and Content posted. In order to renew Membership you will need to contact DoubleDateFirst and arrange payment to gain access to the Services.

10. RIGHT TO REFUSE AND TERMINATION

10.1 DoubleDateFirst has the right to refuse to register Users for Membership and to terminate access to any or all of the Services at any time, delete your Profile and any Content or information posted, without notice, for any reason, including without limitation, any breach of these Terms and Conditions. DoubleDateFirst may also at any time, at our discretion, discontinue the Services or any part thereof without prior notice and the Users agree that DoubleDateFirst shall not be held liable by the Users or any third party for any termination of access to the Services.

10.2 DoubleDateFirst will, in appropriate circumstances and at its sole discretion, terminate Users who are deemed to be repeat infringers and may also at its sole discretion limit access to the Website and/or the Services of the Users who breach these Terms and Conditions whether or not there is any repeat infringement.

10.3 Friend A may cancel Membership at any time, for any reason, upon receipt by DoubleDateFirst of notification through the unsubscribe/cancel link provided on the Website. Upon cancellation of Membership the Profile of Friend A and Friend B and any content posted will be permanently deleted. Friend A cannot transfer the Membership Fee or part thereof to Friend B. To do so is a breach of these Terms and Conditions and DoubleDateFirst may suspend or terminate the Membership.

11. DISPUTES

The Users are solely responsible for their interaction with other Users and DoubleDateFirst reserves the right, but has no obligation, to monitor disputes arising from or relating to the Services or between Users.

12. LINKS TO THIRD PARTY WEBSITES

The Website and/or the Services may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and the Users acknowledge and agree that DoubleDateFirst is not responsible for the content or availability of any such website. If Users decide to leave the Website and access a third party website, Users do so at their own risk and the Terms and Conditions of DoubleDateFirst no longer apply.

13. INTERNATIONAL USE

The Users agree to comply with all applicable laws regarding the transmission of technical data exported from England and Wales or the country in which you reside and with all local laws and rules regarding acceptable use of and conduct of the internet.

14. INTELLECTUAL PROPERTY RIGHTS

14.1 DoubleDateFirst (including without limitation the design, text, graphics and all software and source codes connected with the Website and/or the Services) are protected by copyright, trade mark, patents and other intellectual property rights and laws. In accessing the Website and/or the Services the Users agree to access solely for personal and non-commercial use. None of the Content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of DoubleDateFirst for personal, non-commercial home use only.

14.2 DoubleDateFirst does not claim ownership of any Content posted by the Users, uploaded or submitted by any publicly accessible area of the Services. However, by doing so you are granting DoubleDateFirst a worldwide, royalty free, non-exclusive licence to copy, distribute, transmit, reproduce, publicly display, edit, translate or publish such Content via the Website and/or the Services and/or promotional material. The licence shall be terminated when such Content is deleted from the Website and/or the Services.

15. INDEMNITY

The Users agree to entirely indemnify and hold DoubleDateFirst harmless from and against any breach of these Terms and Conditions and any claim or demand brought against DoubleDateFirst by any third party arising out of the Users use of the Website and/or the Services and/or Content posted, uploaded or submitted through the Services, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by DoubleDateFirst in consequence of any breach of any of these Terms and Conditions.

16. DISCLAIMERS AND LIMITATION OF LIABILITY

16.1 Use of the Website and/or the Services is at the Users risk. The Website and/or the Services are provided on an "as is" and "as available" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to, the implied warranties of satisfaction quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

16.2 To the extent permitted by law, DoubleDateFirst will not be held liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website and/or the Services.

16.3 DoubleDateFirst purpose is not to advise on or broker either marriage or long-term relationships and makes no guarantee that the Website and/or the Services will meet Users requirements, purpose or expectation of a date. DoubleDateFirst has no control over or responsibility for the accuracy of any of the Content posted on the Website by Users, nor that the functionality of the Website and/or the Services will be uninterrupted or error free, that defects will be corrected or that the server that makes the Website available is free of viruses or anything else which may be harmful or destructive. No payment or refund will be given for any downtime or for the inability of Users to access the Website and/or the Services due to technical problems beyond the control of DoubleDateFirst.

17. SEVERANCE

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be removed and the remaining Terms and Conditions shall remain in full force and effect and continue to be binding and enforceable.

18. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and the Users submit to the jurisdiction of the Courts of England and Wales.
